Patient is not told for a year that biopsy revealed prostate cancer

This case involves a year delay in the diagnosis of prostate cancer.  The delay allowed the cancer to spread and eventually kill the patient.  A year prior to his diagnosis the patient saw his internist and complained of urinary problems.  The internist conducted a digital examination and noted that the patient’s prostate was enlarged.  The internist ordered a biopsy which was performed at a local hospital.  When the biopsy samples were examined the pathologist documented in a report that the cells were positive for prostate cancer.  The patient was not informed of this by the internist or the hospital and did not find out he had cancer until a year later.  The law firm that handled this case reported that the matter settled prior to trial.  The amount of the settlement was not disclosed.
